I think the interface could assume that people will generally not want to pass after they've done all the clicking to finish a contract-- perhaps that could lead to a confirmation button ("do you really want to pass? you've selected a contract and cards.") even with confirmations off by default, or the button could be fully disabled, or replaced by a "reset selection" button.
